The new framework for the telephone start: between Naegelen, decree J/F/H and future Cazenave law

For several years now, the telephone market has been subject to increasing legislative and regulatory frameworks to better protect consumers and to limit abusive practices. Three main pieces of legislation follow and complement each other: the Naegelen Act, the so-called "J/F/H" Decree and, by 2026, the Cazenave Act.

Naegelen Law: Authentication of Numbers and Sanctions

The Naegelen law (entered into force on 1 March 2023) marked a first turning point. Its objective is twofold: to regulate the opening of the telephone and to combat fraudulent calls. It requires operators to set up a mechanism for authentication of numbers (MAN), which entered into force on 1 October 2024, based on the STIR/SHAKEN protocol. It is a series of protocols and procedures designed to combat the identity fraud of the caller on public telephone networks. It also gives DGCCRF and operators the power to block fraudulent lines, including those using overtaxed numbers. Finally, it introduces dissuasive sanctions of up to €75 000 for natural persons and €375,000 for legal persons. This text has opened the way for a stricter framework of prospecting practices. J/H/F Decree: days, times and frequency of B2C calls

To make these provisions concrete, a decree was issued to implement the decree

To go further than the J/H/F framework and prepare the generalised opt-in, it is useful to review your collection points: wording of the statements, proof of consent, management of partners and archiving of evidence. Around 2026: the Cazenavian law and the principle of "accepted appeal"

The Cazenave Act, which is now being reformed more radically, is being implemented on this date. Its guiding principle is the concept of "accepted appeal": from the date of its entry into force, no commercial appeal can be made without the express prior consent of the consumer. A decree, probably similar to the Naegelen decree and which should be adopted, will establish the same principle, but the exact days, frequencies and times remain unknown. This evolution marks a shift from a regime of tolerance framed towards a model based on compulsory opt-in. If you work with partners to collect your leads, this guide details the points of vigilance (contracts, traceability, proof of consent):L-framement of the relationship with a lead generator: the right reflexesIn this perspective, the clarity of the messages becomes crucial: each promise must be immediately qualified (for example, "according to profile"), the conditions made visible and the proof of consent easily traceable.
